Welcome to Corkscrew
These Terms of Service ("Terms") govern your use of the Corkscrew platform, which connects event hosts with professional bartenders and hospitality workers in the Dallas-Fort Worth area. By accessing or using our services, you agree to be bound by these Terms.
Corkscrew operates as a marketplace platform connecting hosts and workers. We are not an employer or staffing agency. These Terms establish the rights and responsibilities for all users of our platform.
For Hosts
Booking Requirements
You must be at least 18 years old to book services through Corkscrew
All bookings must be for legitimate events with accurate information
You are responsible for providing a safe, appropriate work environment
Event details must be accurate, including location, duration, and service needs
Your Responsibilities
Provide clear instructions and access to necessary equipment and supplies
Treat workers with respect and professionalism at all times
Ensure the work environment is free from harassment and discrimination
Communicate any changes or issues promptly through the platform
Provide honest feedback and ratings after each event
Prohibited Actions
Circumventing the platform to avoid booking fees is strictly prohibited
Discriminating against workers based on protected characteristics
Making fraudulent bookings or payment disputes
Requesting workers to perform services outside their agreed role
For Workers
Qualifications & Requirements
Valid TABC certification required for all bartending services in Texas
Must pass background check and identity verification
Maintain current certifications and update profile information
Keep availability calendar accurate and up to date
Your Responsibilities
Arrive on time, prepared, and in professional attire
Provide excellent service and represent Corkscrew professionally
Follow all applicable laws and responsible alcohol service guidelines
Communicate professionally with hosts before, during, and after events
Maintain a minimum 4.0 rating to remain active on the platform
Prohibited Actions
Soliciting hosts to book outside the platform
Working while under the influence of drugs or alcohol
No-showing or canceling within 24 hours without valid emergency
Falsifying certifications, experience, or identity information
Fee Structure
Host Booking Fee: 15%
Hosts pay a 15% booking fee on the total cost of services. This fee covers:
Worker verification and background checks
Secure payment processing and fraud protection
General liability insurance coverage
24/7 customer support and dispute resolution
Platform maintenance and instant replacement guarantee
Example: For a 6-hour booking at $35/hour ($210), the total cost would be $241.50 (includes $31.50 booking fee). All fees are shown transparently at checkout.
Worker Platform Fee: 10%
Workers pay a 10% platform fee on earnings. This fee covers:
Marketing and lead generation to bring you customers
Secure, guaranteed payment processing
Liability insurance coverage while working
Customer support and dispute resolution services
Example: For a 6-hour booking at $35/hour ($210), you receive $189 after the 10% platform fee ($21).
Standard payout (Free): 3-5 business days via direct deposit
Instant payout (+3%): Next business day for faster access to funds
Payment Terms
All payments are processed securely through the Corkscrew platform
Hosts are charged at the time of booking, funds held in escrow until event completion
Workers receive payment 3-5 business days after successful event completion
Tips are optional and can be added through the platform or given in cash
All fees are clearly disclosed before booking confirmation
Cancellation Policies
Host Cancellation Policy
48+ Hours Before Event
Full refund, no penalties. Cancel anytime up to 48 hours before your event start time for a complete refund of all fees.
24-48 Hours Before Event
50% refund. Cancellations in this window incur a 50% cancellation fee to compensate the worker for short notice.
Less Than 24 Hours Before Event
No refund. The full payment is retained to fairly compensate the worker who blocked their schedule for your event.
Exceptions: Cancellations due to documented emergencies (severe weather, medical emergencies, etc.) will be reviewed on a case-by-case basis for partial or full refunds.
Worker Cancellation Policy
48+ Hours Before Event
No penalty. You may cancel accepted bookings with no impact on your account or rating.
24-48 Hours Before Event
Warning issued. Your account will receive a warning, and repeated cancellations in this window may affect your standing.
Less Than 24 Hours or No-Show
Account penalties. Your rating will be negatively impacted, and repeated violations may result in temporary or permanent account suspension.
Exceptions: Valid emergencies (illness, family emergency, etc.) with documentation will be reviewed individually and may not result in penalties.
Booking Modifications
Changes to booking time, duration, or location must be agreed upon by both parties
Modifications that increase booking duration will result in additional charges
Workers may decline modification requests that significantly alter the original booking
All modifications must be made through the Corkscrew platform messaging system
Liability & Limitations
Platform Role
Corkscrew operates as a marketplace platform that connects hosts with independent contractors. We are not:
An employer or staffing agency
A party to the service contract between hosts and workers
Responsible for the actions or omissions of hosts or workers
Liable for disputes between hosts and workers beyond our dispute resolution services
Insurance Coverage
All bookings include basic general liability insurance coverage, which provides:
Coverage for accidental property damage during service
Protection against third-party bodily injury claims
Coverage limits and exclusions apply (see full policy for details)
Does not cover intentional misconduct, gross negligence, or criminal acts
Note: Hosts may want to maintain their own event insurance for comprehensive coverage. Workers are independent contractors and should maintain their own liability insurance as well.
Limitation of Liability
To the maximum extent permitted by law, Corkscrew's liability is limited as follows:
Maximum liability capped at the total booking fees paid for the specific transaction
Not liable for indirect, incidental, consequential, or punitive damages
Not responsible for loss of profits, revenue, data, or business opportunities
Not liable for service interruptions, technical errors, or system failures
Dispute Resolution
Report disputes within 24 hours of event completion for fastest resolution
Our support team will investigate and mediate disputes between parties
Decisions are made based on evidence, communication logs, and platform policies
Unresolved disputes may be subject to binding arbitration in Dallas County, Texas
Indemnification
Users agree to indemnify and hold Corkscrew harmless from claims, damages, or expenses arising from:
Your violation of these Terms of Service
Your use or misuse of the platform
Your violation of any third-party rights
Services provided or received through the platform
Additional Terms
Account Termination
Corkscrew reserves the right to suspend or terminate accounts for:
Violation of these Terms of Service
Fraudulent activity or misrepresentation
Repeated policy violations or poor ratings
Abusive behavior toward other users or support staff
Modifications to Terms
We may update these Terms from time to time. When we make material changes:
We'll notify users via email and platform notification
Changes become effective 30 days after notification
Continued use of the platform constitutes acceptance of updated terms
You may terminate your account if you don't agree with the changes
Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the state or federal courts located in Dallas County, Texas. Both parties consent to the exclusive jurisdiction of these courts.
